Resumen de Ponderación de las limitaciones legales a la libertad de testar del causante. El sistema de legítimas en Aragón y en el Código civil

El presente trabajo tiene por objeto valorar la libertad del causante para disponer de su patrimonio tomando en consideración determinados derechos que las normas reconocen a sus parientes más próximos y al cónyuge supérstite. Ello a fin de precisar si la libertad de testar debería ser más permisiva o restrictiva favoreciendo, en mayor o menor medida, bien los intereses del testador bien los intereses de sus familiares. A estos efectos, estudiamos el alcance de los artículos 33 y 39 de nuestra Constitución, para determinar si la legítima puede encontrar en ellos un fundamento que la ampare; analizamos la regulación que de la legítima, el derecho de alimentos y el derecho de viudedad se hace en el Código del Derecho Foral de Aragón, en cuanto reconoce una mayor libertad al testador que la regulada en el Código Civil, y exponemos las novedades que en esta materia han sido introducidas por la Propuesta de Código Civil de la Asociación de profesores de derecho civil.

The current study has the objective to assess the freedom of the testator to make use of his/her patrimony taking into consideration certain rights that the law acknowledges to their close relatives and also to his/her survived spouse. The goal is to determine if the freedom of the testator should either be more permissive or restrictive favoring, to a higher or lesser degree, either the interests of the testator or those of his/her relatives. With this in mind, we will study the scope of articles 33 and 39 of our Constitution, in order to determine a lawful basis for its protection; similarly we will also study the right to maintenance and the widow’s life interest that according to this law is specified in the Foral Civil Code of Aragon, since it acknowledges more freedom to the testator than in the Civil Code. We also identify the novelties that in this regard have been introduced in the Civil Code Proposal presented by the Association of Professors of Civil Law.
