Estrategias de persecución penal contra la financiación del terrorismo

    El notable incremento tanto en la diversificación como en la capacidad de acción y potencial destructivo que ha mostrado la estrategia terrorista en los últimos años, pone en evidencia qué tan importante es estructurar un esquema de prevención y persecución penal de carácter multilateral que resulte óptimo para abarcar por diferentes vías y en sus distintas etapas la actuación terrorista. Un ejemplo de ello radica en el hecho de que la comunidad internacional centre sus esfuerzos en mitigar y reprimir todo aquello que suponga cualquier aportación o recaudación de medios para sufragar el marco operativo de la delincuencia terrorista. Sobre todo desde el 11 de septiembre, se ha enfatizado la necesidad de incriminar la financiación del terrorismo y de emprender acciones destinadas a su prevención e identificación en los ámbitos nacionales, interés prioritario que, como se desarrolla en este trabajo, se ha venido reflejando en algunos instrumentos emitidos por importantes organismos internacionales, a cuyas directrices ha tratado de ceñirse México a través de un reestructurado marco jurídico–penal y de una legislación complementaria de naturaleza preventiva de muy reciente creación.

    The remarkable increment in the diversification as well as the capacity of action and the destructive potential that the terrorist strategy has shown in the latest years, has put in evidence the importance of structuring a prevention and criminal prosecution schema with a multilateral character, that functions well dealing with the terrorist threat in different ways and in the different stages of the terrorist action. An example of this lies in the fact that the international community centers its efforts in mitigating and suppressing anything that supposes any contribution or fund raising to defray the criminal and terrorist operational framework. Overall after September the 11th, the need to criminally pursue the funding of terrorism has been emphasized, and actions have been undertaken towards its prevention as well of its location in the national environment, high priority interest, that as it has been developed in this paper, can be seen reflected in some instruments issued by important international organisms, to which Mexico has tried to adhere to, through a restructured legal-penal frame, and of a complementary legislation of preventive nature of very recent creation.
