La legislación sobre los apartamentos turísticos y viviendas de uso turístico en España, comparativa por comunidades Autónomas

    El objetivo de este trabajo es conocer la legislación española que regula los establecimientos turísticos, concretamente los apartamentos turísticos y las viviendas de uso turístico. Se realiza una revisión de la legislación a nivel nacional y autonómico. La oportunidad de este estudio viene dada por la aprobación este mismo año, en Andalucía, del Decreto 28/2016, de 2 de febrero, de las viviendas con fines turísticos y de modificación del Decreto 194/2010, de 20 de abril, de establecimientos de apartamentos turísticos. Se establece una comparativa de los requisitos legales que existen en cada comunidad autónoma para este tipo de establecimientos. También se aportan y se analizan datos sobre la ocupación de este tipo de establecimientos en cada región. Se concluye con las diferencias más relevantes entre las comunidades a nivel legislativo y a nivel cuantitativo, a nivel de ocupación y de número medio de días de estancia en estos alojamientos.

    The aim of this work is to know the Spanish legislation that regulates tourism establishments, particularly the tourist apartments and homes for tourist use. We make a review of the legislation at national and regional level. The opportunity of this study is given by the approval this year, in Andalusia, of Decree 28/2016, of February 2, about housing for tourism purposes and modifications of Decree 194/2010, of 20 April, about establishments of tourist apartments. We make a comparative of legal requirements that exist in each region for such establishments, as well as provide and analyze data on their occupation in each region. We conclude with the most relevant differences between communities at the legislative and quantitative level, as well as occupancy and average number of days of stay in these accommodations.
