  • Angesichts komplexer gewordener Fusionskontrollverfahren und im Interesse der Transparenz behördlicher Verfahren wird in dem Beitrag vorgeschlagen, dass das Bundeskartellamt ähnlich wie die Europäische Kommission, idealerweise nach einem vorgeschaltetem Konsultationsverfahren, Best Practices zur Fusionskontrolle verabschieden sollte. Als mögliche Regelungsgegenstände werden Besprechungen mit der zuständigen Beschlussabteilung, Zugang zu Beweismaterial und Stellungnahmen vor der Abmahnung, Behandlung von Geschäftsgeheimnissen, die Rolle von Beschwerdeführern und weitere relevante Themenkreise erörtert.Need for Best Practices in German Merger ControlIn light of the increased complexity of merger review and limited publicly available information on the handling of proceedings by the Federal Cartel Office the author recommends the publication of Best Practices for German merger control proceedings after a consultation process with the relevant stakeholders. Possible topics to be covered are meetings with the case team, pre-notification discussions, access to evidence before statement of objections, the treatment of business secrets, deadlines for submissions, the role of the Federal Cartel Office’s economic unit, the role of complainants, a hearing officer function, and the handling of internal documents. The publication of such Best Practices for German merger control proceedings would increase transparency and predictability of German merger proceedings and thereby reinforce confidence in merger control as an institution
