Con base en el principio de que toda servidumbre debe causar la menor molestia o incomodidad posible al predio sirviente, la Ley permite modificarla cuando su ejercicio sea demasiado gravoso y pueda ofrecerse una alternativa de semejante utilidad. Tal facultad, generalmente conocida como ius variandi, suscita no obstante importantes dudas, que a juicio del autor no han recibido atención suficiente por parte de la doctrina y los Tribunales.

Based on the principle that any easement should cause the least possible disruption or discomfort to the servient property, the law allows to modify it when its exercise is too burdensome and an alternative of similar utility can be offered. Such a power, usually known as ius variandi, raises however serious doubts, that in the opinion of the author have not received sufficient attention on the part of the doctrine and the courts.
