  • Im Kartellschadensersatzrecht kann die Anwendung nationaler Vorschriften nur im europarechtlichen Kontext erfolgen. Die Gewährleistung der Wirksamkeit des europäischen Kartellrechts erfordert eine am Effektivitätsgrundsatz ausgerichtete Auslegung der nationalen Normen. Sofern der Verjährungsbeginn nach deutschem Recht weiter an den Abschluss eines für den Geschädigten nachteiligen Vertrages anknüpft und der Hemmungstatbestand des § 33 Abs. 5 GWB a. F. lediglich auf Ansprüche angewendet würde, die ab Juli 2005 entstanden sind, so wäre die kenntnisunabhängige zehnjährige Verjährungsfrist für Kartellschadensersatzansprüche mit dem Effektivitätsgrundsatz nicht vereinbar.EU-law aspects of suspension of statute of limitations under German lawWhen applying national legal provisions to cartel damages claims, the EU law context needs to be considered. To ensure that European competition law is effectively implemented, national laws need to be construed in accordance with the principle of effectiveness. Against this background: should the German long-stop limitation period commence to run from the point in time when a contract affected by anti-competitive behavior was concluded, and should at the same time the suspension of the limitation period according to section 33 (5) Act against Restraints of Competition (prior 2017) only apply to claims arising from July 2005 onwards, the German long-stop limitation period of ten years for cartel damages claims could not be considered compatible with the principle of effectiveness and would therefore be in violation of EU law.
