Resumen de Las monedas virtuales y el capital riesgo: realidad, función económica, naturaleza y consideraciones jurídicas sobre el Bitcoin

El Bitcoin, junto al resto de monedas virtuales y la tecnología que las desarrolla, el Blockchain, siguen siendo grandes desconocidas, tanto para la sociedad, como para el sector empresarial y financiero en España. Por ello, el presente trabajo intenta arrojar luz sobre cuestiones que afectan principalmente a la realidad del fenómeno, su función económica y naturaleza jurídica, en un intento por identificar los riesgos intrínsecos de las monedas virtuales, así como sus posibles soluciones dentro del marco de nuestro Ordenamiento jurídico, a falta de una normativa europea o española que regule este sector en auge. Precisamente, diversos organismos europeos, entre ellos, el Banco Central Europeo y la Autoridad Europea Bancaria, han solicitado a la Comisión europea y al Parlamento, una nueva modificación en la Directiva sobre blanqueo de capitales y financiación del terrorismo, con el fin de luchar contra el cibercimen, cuyas principales medidas analizamos en el presente trabajo. Por último y no menos importante, analizamos la tributación del Bitcoin y del resto de criptomonedas, con el fin de dar respuestas sobre esta materia a inversores que apuestan por este sector, siendo útil para un sector que, en el corto y medio plazo, se presenta como un sector de fuerte crecimiento, con importantes oportunidades de negocios como, las inversiones en startups a través de ICOs, sociedades del sector de las monedas virtuales y empresas desarrolladoras de Blockchain.

Bitcoin, along with the rest of virtual currencies and the technology that develops them, Blockchain, remain as a great unknown both for society, and for the business and financial sector in Spain. Therefore, the present work tries to shed light on issues that mainly affect the reality of the phenomenon, its economic function and its legal nature, in an attempt to identify the intrinsic risks of virtual currencies, as well as their possible solutions within the framework of our legal system, in the absence of a European or Spanish regulation that regulates this booming sector. Indeed, a number of European organisms, including the European Central Bank and the European Banking Authority, have asked the European Commission and Parliament for a new amendment to the Money Laundering and Terrorist Financing Directive in arder to combat cybercime, whose main measures are analyzed in the present paper. Last but not less important, we analyze the taxation of Bitcoin and the rest of the criptocurrencies, in arder to give answers on this matter to investors who bet on this sector, being usefui for a sector that. in the short and medium term, presents as a sector of strong growth, with important opportunities in businesses such as investments in, startups through ICOs, companies of the virtual currencies sector and Blockchain development companies.
