Resumen de Ruptura de la pareja de hecho: ¿ atribución del uso de la vivienda familiar?

  Cuantiosa ha sido, de un tiempo a esta parte, la casuística planteada ante los tribunales acerca de las parejas no casadas, principalmente referida al momento en que dicha unión entra en crisis y se pretende una solución —una regulación— que, al momento de formarse la pareja, ésta rechazaba. Entre las diversas pretensiones que se han planteado, destacan las de tipo económico, grupo en el que podemos encuadrar la que en este trabajo nos ocupa: la atribución, o no, del uso de la vivienda de la pareja una vez que se produce la ruptura de ésta. A lo largo del presente trabajo estudiaremos la evolución que ha experimentado tanto la jurisprudencia como el derecho foral en relación a la atribución de este derecho de uso. Abandonada la aplicación analógica, con carácter general, del art. 96 CC a las uniones no matrimoniales, ahora resultará trascendental, a efectos de la consabida atribución, la existencia, o no, de hijos comunes dependientes de la pareja.

  For some time, the casuistry raised before the courts about unmarried couples has been large, mainly referring to the time in which such couples enter into crisis and seek a solution - a regulation - that, at the time of forming the couple, the couple rejected. Among the vavarious claims that have been raised, the economic claims should be highlighted; in this group we can include the claim which is the subject of this paper: the attribution, or not, of the use of the family dwelling of the couple once the couple has broken up. Throughout this work, we will study the evolution that has experienced both the case law and the Special Regional Law (derecho foral) in relation to the attribution of this right of use of the couple dwelling. Since the analogous implementation of the general rule of Section 96 of the Civil Code cannot be used to the non-marital unions, now it will be essential, for the purposes of that dwelling attribution, to determine the existence, or not, of common dependent children of the non-married couple.
