    La disolución del vínculo matrimonial conlleva la necesidad de adoptar una serie de decisiones sobre el cumplimiento de las deudas constituidas constante matrimonio, entre otras, la amortización de los préstamos hipotecarios sobre la vivienda habitual. La consideración que se tenga de este tipo de deudas determina la decisión sobre el reparto de su pago entre los cónyuges. En este sentido, la jurisprudencia ha basculado hasta tiempos recientes entre su consideración como carga del matrimonio o como deuda de la sociedad de gananciales. En este trabajo se analizan dichas opciones y las implicaciones que las mismas tienen respecto de dicho reparto, así como también las diversas consecuencias procesales que generan. Todo ello, sin olvidar que la atribución de un derecho de uso sobre la vivienda conlleva la necesidad de determinar su afección a los derechos de terceros.

    The dissolution of the marriage entails the need to adopt a series of decisions on the payment of the debts incurred during the marriage, among other, the capital repayment of the mortgage loans on the main dwelling. The study of this type of debt determines the decision on the distribution of its payment between the spouses. In this sense, the case law has tilted up until recent times among its consideration as a burden of marriage or as a debt of the joint ownership of matrimonial assets. In this paper we analyse these options and the implications that they have with respect to such distribution, as well as the various procedural consequences they generate. All this, without forgetting that the attribution of a right of use on the main family dwelling implies the need to determine its condition linked to the rights of third parties.
