Resumen de Denegación de la guarda y custodia compartida de un perro por Sentencia del Juzgado del Primera Instancia nº 40 de Madrid

Con fecha 12 de marzo de 2013, el Juzgado de Primera Instancia nº 40 de Madrid dictó Sentencia por la que mi representado mantiene la titularidad exclusiva sobre su perro, sin ninguna obligación de llevar a cabo una custodia compartida del mismo con su expareja, tal y como solicitaba el demandante. En la prueba practicada en el procedimiento se pudo demostrar que mi mandante era la única propietaria del animal, al haber sido un regalo de un familiar, y estar el chip y otra documentación relativa al perro a su nombre. El fundamento jurídico se basa en que la propiedad se considera un bien privativo (artículo 1.346 del Código civil).

On March 12, 2013, the Judge of District Court no. 40 of Madrid dictated the Sentence in which my defendant maintains exclusive ownership of her dog, without any obligation to provide shared custody with her ex–partner as requested by the complainant. In the test practiced within the proceeding it was possible to demonstrate that my client was the sole owner of the animal, having received the dog as gift from a family member, and that the chip and other documentation regarding to the dog was in her name. The legal foundation is based on the concept that property is considered a private good (article 1.346 of the Civil Code).
