Cuando el régimen económico del matrimonio es el de la sociedad de gananciales, no cabe considerar de carácter ganancial y, por tanto, común, el importe de una indemnización obtenida por uno de los cónyuges por incapacidad laboral de carácter permanente. en este caso la indemnización corresponde en exclusiva al incapacitado.

When the economic regime of marriage is that of the community of acquisitions, the amount of compensation obtained by one of the spouses due to permanent incapacity for work can not be considered to be community property and, therefore, common. in this case, the compensation corresponds exclusively to the incapacitated person.
