  Partiendo de la idea que la dogmática cumple un rol de garantía en la aplicación concreta de las normas penales, el autor propone la delimitación de la Seguridad Vial desde la teoría del Bien jurídico y sus funciones. Sobre dicha premisa y desde la función político criminal de esta teoría, se analiza críticamente la tesis que sostiene la naturaleza de Bien Jurídico Colectivo sin referente individual de la seguridad Vial, en cuanto ésta nada resuelve sobre la dudosa legitimación de la intromisión penal en esta área, y por el contrario, daría pie

  Starting from the idea that dogmatic assurance plays a role in the concrete ap-plication of criminal laws, the author proposes the delimitation of Road Safety from the theory of legal good and functions. On this premise and from the criminal political function of this theory, the thesis critically analyzes the nature of holding Legal Collective good no single benchmark for Road Safety, as it solves nothing about the questionable legitimacy of criminal intrusion in this area and on the contrary would lead to inconsistent results with Criminals Policy democratic rule of law, such as, firstly, the use of criminal law as a simple strengthening administrative rule or, on the other, separating the Safety itself as a Legal Good
