A partir de la sentencia del Tribunal Supremo 364/2016, de 3 de junio, sobre el carácter abusivo de la cláusula relativa a los intereses moratorios en los préstamos hipotecarios con consumidores y de las dos cuestiones prejudiciales planteadas ante el Tribunal de Justicia de la Unión Europea, se analiza la diferencia entre intereses moratorios e intereses ordinarios y se da noticia de las recientes conclusiones del Abogado General de la Unión Europea en relación con la distinción entre ambas categorías y su distinto tratamiento. Se ofrece un juicio crítico sobre la regulación que propone al respecto el Proyecto de Ley reguladora de los contratos de créditos inmobiliarios.
Taking as a starting point the judgment of the Supreme Court 364/2016, of June 3, on the abusive nature of the clause relating to default interest on mortgage loans with consumers and the two preliminary rulings submitted to the Court of Justice of The European Union, analyzes the difference between default interests and ordinary interests and reports the recent conclusions of the Advocate General of the European Union regarding the distinction between both categories and their different treatment. Critical judgment is offered on the regulation on the subject proposed by the Draft Law regulating real estate contracts.
