  The article intends to explore the place of the figure of the contemporary victim in the dynamics of the Brazilian justice system and its protagonism in the process of building the contours of democracy in the country. In light of this objective, we analyze in this text experiences of relatives of victims of armed violence in their contacts with legal institutions in Brazil. In a social arrangement where the evaluation of the legitimacy of democratic regimes passes through the control of the practices of their agents, relatives of the dead and disappeared in São Paulo emerge in the Brazilian public sphere questioning the jurisdictional competence of the procedures, investigations and trials of the processes that began more than a decade in the state judicial sphere.

  O artigo pretende explorar o lugar da figura da vítima contemporânea nas dinâmicas do sistema de justiça brasileiro e seu protagonismo no processo de construção dos contornos da democracia no país. Frente esse objetivo, analisamos no presente texto experiências de familiares de vítimas da violência armada em seus contatos com as instituições jurídicas no Brasil. Em um arranjo social onde a avaliação da legitimidade dos regimes democráticos passa pelo controle das práticas dos seus agentes, familiares de mortos e desaparecidos em São Paulo emergem na esfera pública brasileira questionando as competências jurisdicionais dos trâmites, investigações e julgamentos dos processos que iniciaram a mais de uma década na esfera jurídica estadual.
