Familias transnacionales y derechos humanos: reflexiones sobre el derecho a la reagrupación familiar en España

    La reagrupación familiar de las personas inmigrantes constituye un creciente objeto de estudio en el ámbito académico. El derecho a la vida familiar es reconocido por los principales instrumentos de derecho internacional y doméstico, tanto por los beneficios que ésta comporta para las personas como para las sociedades en su conjunto, puesto que se le reconoce a la familia una importante función integradora. Frente a este discurso encontramos la creciente transnacionalización de las familias de inmigrantes, abocadas a vivir en la distancia las funciones que otras ejercen en ámbitos cada vez más amplios y estables, dada la creciente restricción del derecho a la vida familiar para las personas inmigrantes mediante reagrupación en destino. El artículo analiza de forma reflexiva la situación contradictoria entre los derechos humanos, por un lado, y la situación familiar trasnacional forzada de muchos inmigrantes, por otro. Considerar a la familia transnacional como un nuevo tipo de familia tiene, cuando menos, algunas sombras que deben ser matizadas.

    The family reunification of immigrants is an increasing object of study in the academic field. The right to family life is recognized by the main instruments of international and domestic law, both for the benefits that it entails for individuals and for societies as a whole, since the family is recognized as an institution with an important integrating function. In the face of this discourse we find the growing transnationalization of immigrant families, who are forced to live in the distance the functions that others exercise in increasingly broad and stable areas, given the growing restriction of the right to family life for immigrants through reunification at host society. The article analyzes in a reflexive way the contradictory situation between human rights, on the one hand, and the forced transnational family situation of many immigrants, on the other. To consider the transnational family as a new type of family has, at least, some shadows that must be clarify.
