El ámbito jurídico internacional es el principal pilar jurídico en el tratamiento de la violencia contra la mujer, y donde se proclama su reconocimiento internacional. Es el ámbito que ha estudiado la violencia contra la mujer como fenómeno universal, hasta llegar a identificarla como una violencia polifacética, y dirigida específica y desproporcionadamente contra un grupo humano. No obstante, a finales del siglo XX se produce una interconexión entre el ámbito internacional de los derechos humanos y el ámbito penal internacional. Y la gran beneficiada de esta interconexión es la materia de mujer, porque se detecta que los crímenes de género o crímenes con gender underlie se perpetran en función de cómo se asume la idea de la masculinidad y la idea de la feminidad. El daño perpetrado en mujeres y niñas, y en hombres y niños, está basado en construcciones sociales diferentes. Y en particular, las mujeres y las niñas, en este contexto, sufren una violencia sistemática y masiva respecto de los hombres y de los niños, habiendo quedado recogida como norma de prohibición. No obstante, el acto más grave de violencia sistemática es la violencia femicida, o muerte violenta por razón de género.

The juridical international area is the principal juridical base in the treatment of the violence against the woman, and where his international recognition is proclaimed from 1993. Nevertheless, at the end of the 20th an interconnection takes place between the international area of the human rights and the penal international area. And the great one benefited from this interconnection is the matter of human rights of the woman, because there is detected that the crimes of kind or crimes with gender underlie perpetrate depending on how there is assumed the idea of the masculinity and the idea of the femininity. That is to say, the hurt perpetrated in women and girls, and in men and children, it is based on social different constructions.Especially, the women and the girls, in this context, suffer a systematic and massive violence respect of the men and of the children, that in evolution it is a systematic discrimination because of sex, there being permeado this conception up to the ius cogens. And as more serious act of systematic violence, the violence femicida, or death forces because of gender.
