Resumen de El crimen organizado: especial consideración a Iberoamérica

  El mundo globalizado en el que vivimos, nos ha reportado enorme beneficios pero también ha conllevado el crecimiento y expansión de la delincuencia organizada transnacional. Este tipo de delincuencia, cada vez es más sofisticada, ha logrado incorporarse a las instituciones públicas. Ello le permite actuar desde el Estado para la búsqueda de impunidad y para dotar de apariencia de legalidad los beneficios obtenidos con el crimen. Lamentablemente, Iberoamérica es en una de las regiones más afectadas por esta situación en la que se está trabajando para su evitación creando unidades de transparencia. Tradicionalmente, los entramados criminales que venían actuando en el territorio de un solo Estado, se han expandido logrando la hermandad con otras organizaciones, logrando la transnacionalización de sus acciones criminales. Ante esta situación, la acción de un solo Estado es insuficiente frente a una actividad criminal organizada que sobrepasa las fronteras. Es necesario que se supere el concepto de soberanía y los diferentes países aúnen esfuerzos para la cooperación con el fin de acabar con esta lacra social. En este sentido, tanto los convenios bilaterales como los acuerdos firmados por las organizaciones internacionales iberoamericanas así como con las organizaciones europeas de cooperación son imprescindibles.

  The globalized world in which we live has brought along with it huge benefits but also in the other hand has led to the growth and expansion of transnational organized crime. This type of crime is becoming more and more sophisticated and it even has made its way into public institutions. This fact has allowed criminals to search for impunity using the infrastructure of the State, as well as to give appearance of legality to the benefits obtained from crime. Unfortunately, Latin America is one of the regions most affected by this situation in where however it is possible to identify relevant institutional efforts in order to create transparency units. Traditionally, criminals who were acting in just a single State have expanded the brotherhood with other organizations, achieving the transnationalization of their criminal actions. In view of the above, the action of just a single State facing an organized criminal activity that now transcends the boundaries appears clearly insufficient. This way, it becomes necessary to overcome the concept of sovereignty and get the countries to join efforts for cooperation in order to put an end to this social scourge. In this regard, both bilateral conventions and agreements signed by the Ibero-American international organizations as well as with the European organizations of cooperation are essential.
