    La teoría de la Constitución-marco no responde a las exigencias del Estado social-democrático, que exige y se apoya en la Teoría de la Constitución-fundamento. Esta segunda Teoría, nunca ha sido abrazada y desenvuelta sin reparos por la jurisdicción constitucional española, sobre manera, en el último decenio. No se ha adentrado ni decidido nuestro Tribunal Constitucional a explorar y explotar la totalidad de posibilidades de la Constitución-fundamento en su auténtico sentido emancipador. Cercana, incluso parcialmente solapada, hallamos a la Teoría de la Constitución del pluralismo. Tal teoría constitucional, propia del dinamismo abierto al futuro y cargada de material de esperanza, encomienda a la Norma Suprema el cumplimiento de un doble objetivo: garantizar la cohesión social y encauzar la apertura al futuro, pues ha de señalar también un horizonte de expectativas materiales, y resulta así válida para un pretérito (presente) de constitucionalismo transnacional, cooperativo y cosmopolita.

    The theory of the Constitution-framework does not respond to the demands of the social-democratic State, which demands and is supported by the Theory of the Constitution-foundation. This second theory, has never been embraced and unwrapped without qualms by the Spanish constitutional jurisdiction, in a way, in the last decade. Our Constitutional Court has not entered or decided to explore and exploit the totality of possibilities of the Constitution-foundation in its authentic emancipatory sense. Close, even partially overlapping, we find the Theory of the Constitution pluralism. Such a constitutional theory, characteristic of the dynamism open to the future and loaded with material of hope, entrusts the Supreme Norm with the fulfillment of a double objective: to guarantee social cohesion and to channel the opening to the future, since it must also point out a horizon of material expectations, and is thus preterit (present) of transnational constitutionalism, cooperative and cosmopolitan constitutionalism.
