Las Directivas europeas sobre contratación y sobre recursos, así como las sentencias del Tribunal de Justicia de la Unión Europea, han supuesto la constante adaptación de la normativa española sobre contratación pública, lo que ha desembocado en un régimen legal de tutela de los licitadores complejo y fragmentado, que el legislador no parece dispuesto a solucionar
The European Public Procurement and Remedies Directives and the judgements of the European Court of Justice have involved the constant adaptation of the Spanish regulation on Public Procurement. This has led to a complex and fragmented legal regime for the tutelas or effective protection for the tenderers, which the legislator seem to be unwilling to solve.
