Aproximación a una Personalidad Jurídica Específica para los robots

    El Parlamento Europeo, el 16 de febrero de 2017, emitió una Resolución (2015/2103(INL)) con recomendaciones destinadas a la Comisión sobre normas de Derecho civil sobre robótica, entre las que señalaba la posibilidad de crear una personalidad jurídica específica para los robots. Este artículo ofrece una aproximación a esta nueva personalidad jurídica, que junto con la persona física y moral constituirá un tertium genus en los entes con personalidad. Se abordará la naturaleza filosófica que sirve de sustento a la personalidad jurídica de los robots, así como la regulación de la figura jurídica que haya de servirle de símil; igualmente se examinará la denominación que haya de recibir la personalidad jurídica, contraponiendo el término sugerido «persona electrónica» con el más completo «persona ciberfísica»; se analizará la evolución tecnológica que haya de producirse para que los robots reúnan las condiciones exigidas por el Parlamento para ser tributarios de Personalidad Jurídica y por último el contenido de derechos, responsabilidades y deberes de los que el robots sea titular, especificando los distintos tipos de culpa que puedan operar en la interacción del robot con los seres humanos, ante la posibilidad de un hecho dañoso.

    On February 16th, the European Parliament issued a Resolution (2015/2103 (INL)) with recommendations towards Civil Law Rules on robotics; within those recommendations, the European Parliament pointed out the possibility of creating a specific legal status for robots. This article offers an approach to this new legal status, which together with physical person and moral person, will constitute a tertium genus in legal status of entities. Furthermore, the philosophical nature that serves as a support to the legal status of robots will be addressed, as well as the regulation of the juridical figure that will serve as simile. Likewise, the denomination that has to receive this legal status will be examined, contrasting the legal term suggested “eletronic person” with that more accurate term “cyberphysical person”; in addition the technological evolution that has to take place will be analyzed so that the robots may gather the conditions required by the Parliament to be entitled with the Legal Status; lastly, it will be examined as well the content of the rights, responsibilities and duties that robots can be entitled with, with an specific approach to the liability of robots in theis interaction with human beings in the case of a harmful event.
