Resumen de Quem são elas e o que elas dizem?: Representações das mulheres usuárias dos juizados (ou varas) de violência doméstica em seis capitais brasileiras

  This article is based on findings from a national research project entitled “Between Retributive “”: the Maria da Penha Law and its application by the Brazilian Judiciary” and funded by Brazil’s National Council of Justice. The aim is to present a profile of female victims who had their cases dealt with by domestic violence courts located in six different Brazilian cities, as well as to assess their experiences with the criminal justice system. In this vein, documentary analysis of court files was performed to collect quantitative data on these women’s socioeconomic backgrounds. As for the qualitative component of the study, semi-structured interviews were conducted with victims who entered the gates of these specialised courts. On the one hand, it was found that, as the typical clients in the criminal justice system, most victims in the domestic violence courts included in this study are poor and working class women. On the other hand, findings suggest that the criminal justice system’s bet on retributive-punitive practices to deal with cases involving domestic violence against women often leads to processes of secondary victimization.

  Este artigo é fruto da pesquisa “Entre práticas retributivas e restaurativas: a Lei Maria da Penha e os avanços e desafios do Poder Judiciário”, financiada pelo CNJ, e possui como objetivo apresentar quem são as vítimas de violência doméstica usuárias dos Juizados (ou Varas) de Violência Doméstica, bem como investigar suas expectativas e suas frustações ao enfrentarem os seus conflitos no âmbito do Sistema de Justiça Criminal. Para tanto, foi realizada pesquisa de caráter quantitativo (pesquisa documental) e qualitativo (entrevistas semiestruturadas com mulheres vítimas) em Juizados (ou Varas) de Violência Doméstica e Familiar contra a Mulher de seis capitais brasileiras. A sugestão empírica é a de que a clientela desses juizados corresponde a uma camada menos abastada da população, típica da justiça criminal tradicional, e que a aposta no modelo de justiça retributiva desemboca, em maior ou menor grau, em processos de revitimização das mulheres em situação de violência que enfrentam os seus conflitos no âmbito da justiça penal.
