En el presente trabajo se abordará un estudio comparativo entre el sistema de garantías jurídico-penales del Antiguo Régimen y cómo la legislación innovadora de las Cortes de Cádiz permitieron aflorar un sistema de garantías moderno, y en concreto la abolición de la tortura como medio de obtención de pruebas. Así se tomará cuenta del estado de la cuestión a día de hoy, y las diferentes patologías que aún remanecen.
This paper is a comparative study between criminal-legal guarantees system of Former Regime and how the ground-breaking legislation by the Cortes of Cádiz allowed a modern system of guarantees, in particular the abolition of torture as a valid mean of taking evidence. Thus, it will be take in consideration the status of the matter today, and the different pathologies that still remaining.
