Resumen de Vidas que importan: panorama sociojurídico de prevención y tratamiento del VIH/SIDA en Colombia

  El presente artículo ofrece un panorama sociojurídico de la prevención y el tratamiento del VIH/SIDA en Colombia. Tras introducir al lector en la temática, con algunos conceptos básicos, información sobre los orígenes, historia y situación actual del VIH/SIDA a nivel nacional e internacional, y presentar el problema, objetivos y metodología de la investigación. Los autores hacen un recorrido por la normatividad, jurisprudencia y políticas públicas que han hecho frente a este fenómeno social de alto impacto en el país desde la década de los ochentas. A través de un trabajo de archivo, análisis normativo y jurisprudencial, y entrevistas semiestructuradas, el equipo de investigación presenta en este documento la postura del Estado colombiano, en sus ramas, ejecutiva, legislativa y judicial, frente a la prevención y tratamiento del VIH/SIDA, así como la postura de expertos nacionales frente al tema.

  Se cierra el texto con algunas conclusiones y recomendaciones entre las cuales se encontraron, el interés del Estado colombiano por reaccionar de forma más eficaz a las necesidades de la población en general en materia de prevención, y a las de las personas que viven con VIH/SIDA en términos de tratamiento y calidad de vida. Así mismo, son visibles factores estructurales que afectan la calidad de vida de la población general, tales como la desigualdad en la distribución de la riqueza, los obstáculos de acceso y la deficiente calidad de un sistema de seguridad social en salud que no responde a las necesidades de sus pacientes, muchos de ellos con padecimientos de afecciones crónicas y de alto costo.

  This article offers a socio-legal panorama of the prevention and treatment of HIV / AIDS in Colombia. After introducing the reader to the subject with a few basic concepts and information about the origins, history and the current situation of HIV / AIDS at the national and international level, and presenting the problem, objectives and methodology of the research, the authors expose the main regulations, jurisprudence and public policies that have faced this social phenomenon of high impact in the country since the early 1980s. Through an archival work, legal and case analysis, and semi-structured interviews, the research team presents the posture of the Colombian state -in its executive, legislative and judicial branches- on the prevention and treatment of HIV / AIDS and the position of national experts on the subject.

    This text closes with some conclusions and recommendations, among which are found the Colombian state interest to react more effectively to the needs of the general population in prevention, and the needs of the HIV population in treatment and life quality. Also, the structural factors, that are visible, and affect life quality of general population, such as inequality of wealth distribution, the access barriers and the deficient quality of a social security system in health, that is unresponsive to the patient needs, many of them with chronic and high cost diseases.
