Los últimos años los diferentes sectores de estudiantes, enseñanzas medias y universitarias, hanejercido numerosas acciones en reivindicación desus derechos, de los que podemos destacar la inasistencia a clase, como actuación de mayor intensidad,todo ello al amparo de un mal llamado «de rechode huelga» que no existe entre los estudiantes, perosi opera con una fuerte creencia, cuando de lo que hay que hablar es del derecho «al paro académico»,piedra angular a cuyo estudio se dedica esta aportación, diseccionando el régimen juridico en los distintos niveles de enseñanza, a la vez que se pretende aportar lo que podria ser el contenido de su regulación

In recent years some students, in the high school and university education sectors. have exercised actions in vindication of their rights of which wecan highlight the absence of class, as a major action, all of them under the protection of an confusing rigth called «right to strike». This right does not exist among students, but operates with a strong belief in contrast of what really needs to be talked: the right of «academic not attend courses». This idea is a cornerstone ithis contribution. In this way the paper analyses the legal framework from different levels of education at the same time that it provides some ideas about future regulation along this question.
