Resumen de Autonomía y manifestación de la voluntad en el testamento vital y documento de voluntad anticipada en México

  El presente trabajo tiene como finalidad dar a conocer el documento de voluntad anticipada existente en México. Este forma parte de una lucha que se ha dado a lo largo de los últimos años en el mundo por legalizar la llamada muerte asistida, comúnmente conocida como eutanasia. El hecho de dar a conocer los lineamientos legales de la voluntad anticipada a los servidores de la salud y a los pacientes permitirá que la voluntad de los pacientes terminales, con daños irreversibles, sea validada sin sanción penal para el médico. Al existir una regulación vigente es viable que los particulares la lleven a cabo, aunque el desconocimiento es real y su procedimiento es mínimo por parte de los notarios públicos. Para hacer esta investigación, realizamos un estudio de conceptos desde la perspectiva del derecho civil. El documento de voluntad anticipada en otros países lleva el nombre de testamento vital; dicho término se relaciona con el aspecto sucesorio; por lo tanto, se examinarán la manifestación de la voluntad, los conceptos de muerte asistida y su regulación internacional, para analizar posteriormente la Ley de Voluntad Anticipada en el Distrito Federal.

  This paper aims to introduce the living will currently existing in Mexico. It forms part of a struggle that has been taking place over recent years in the world in order to legalize so-called "assisted suicide", that is commonly known as euthanasia. The fact of getting to know the legal alignments of a Living Will to health workers and patients will allow the will of terminal patients, with irreversible damages, to be valid, without any criminal sanction to the doctor. With the existence of a regulation in force, it is feasible for individuals to carry it out, even though the ignorance may be real and the procedure is minimal for the public notaries. In order to do this research, we made a study of concepts from the perspective of civil law. The Living Will is known by the name of Testament Vital in other countries; this term is related to the appearance of succession; thus, this paper will examine the manifestation of the will, the concept of assisted death and its international regulation. Thereafter the laws pertaining to the Living Will will be located and assessed in the District Federal of Mexico City.
