A presente investigação tem como objeto a perspectiva naturalista da liberdade individual e suas consequências para a culpabilidade jurídico-penal, especialmente no espaço do neurodeterminismo. O objetivo central, além de apresentar os pormenores deste pensamento, é sustentar a tese de que tal perspectiva naturalista provoca um déficit de normatividade na fundamentação da culpabilidade jurídico-penal e que, por isso, não é ela adequada para direito penal no Estado Democrático de Direito.

The present research aims at the naturalistic perspective of individual freedom and its consequences for criminal-legal culpability, especially in the space of neurodeterminism. The central objective, besides presenting the details of this thought, is to support the thesis that this naturalistic perspective causes a lack of normativity in the foundation of criminal-legal culpability and that therefore it is not suitable for criminal law in the Democratic State of Law.
