Resumen de Notas sobre la comunidad de bienes: reglas básicas y algunas cuestiones litigiosas

Las situaciones en las que existe comunidad de bienes o de derechos han sido objeto de una fuente copiosa de conflictos. El tema propuesto en este estudio pretende analizar la comunidad ordinaria pro indiviso, figura nítidamente delimitada en el Código Civil español (artículos 392 a 406). Sin embargo, estas reglas básicas que ordenan las relaciones entre comuneros, cotitulares o condóminos, si bien son de planteamiento aparentemente sencillo, resultan complejas desde una perspectiva práctica. La diversidad de matices a considerar genera de ordinario cuestiones controvertidas, que serán abordadas desde un punto de vista doctrinal y jurisprudencial. No es objeto de este trabajo establecer conclusiones definitivas, sino mostrar algunas notas sobre la realidad y la aplicación práctica de las reglas que disciplinan esta vieja institución, la cual está al servicio de problemas cotidianos en el tráfico jurídico y los resuelve.

Situations in which there is a community of goods or rights have been the subject of a copious source of conflicts. The theme proposed in this study, intends to analyze the ordinary community pro indiviso, figure clearly defined in the Spanish Civil Code (articles 392 to 406). However, these basic rules that order the relations between comuneros, co-owners or condominiums, although they are of an apparently simple approach, are complex from a practical perspective. The diversity of nuances to consider usually generates controversial issues, which will be addressed from a doctrinal and jurisprudential point of view. It is not the object of this paper to establish definitive conclusions, but to show some notes on the reality and practical application of the rules that discipline this old institution, which is at the service and solves daily problems in legal traffic.
