    El presente trabajo jurídico-reflexivo, cuyo abordaje se hace desde la perspectiva cualitativa con una revisión bibliográfica-documental, tiene como objetivo revisar la actitud racional de los jueces respecto a la cientificidad de la prueba. Parte de la dificultad que se encuentra en el quehacer judicial de los administradores de justicia a la hora de valorar pruebas científicas allegadas al proceso, toda vez que, para ello, se requiere un cúmulo de conocimientos metajurídicos que, en la mayoría de los eventos, no existe. Esta situación conlleva a concluir que el juez termina confiando ciegamente en lo indicado por los expertos a la hora de entregar su informe pericial y dando, así, vía libre a que entren al proceso pruebas malogradas, y, sobre todo, que se resuelvan procesos sin una real valoración de ellas ni un estudio correcto acerca de la idoneidad del perito experto.

    This legal-reflective work, developed from a qualitative perspective with a literature review, aims at analyzing the rational attitude of judges regarding the scientific nature of the evidence. This paper sets out the difficulty encountered during the judiciary labor of justice administrators when evaluating the scientific evidence presented in different legal proceedings, since a set of extrajudicial information is required for that purpose. In most cases, this knowledge is non-existent. As a result, the judge is led to blindly trust what it is specified by the experts in their reports, thus, opening a door into the process to flawed evidence and allowing legal proceedings to be solved without a real assessment of them or the suitability of the expert.
