The author reconstructs the foundation of limits to the freedom of expression of judges, by reference to the various Constitutional principles at play. The essay focuses in particular on the expression of judges' views outside of their judicial function (s.c. extra-functional speech). It also critically examines the evolution of these limits in the Italian judicial system, with specific reference to disciplinary decisions against judges. Finally, the author advances a "de iure condendo" proposal, advocating the disciplinary sanctionability (and so a limitation of the judge's freedom of expression) of public expression of the judge's political positioning.
