Resumen de Xavier Zubiri: Un giro hermenéutico jurídico hacia la Metafísica madura

La hermenéutica jurídica entendida como el sentido que tiene el derecho, es la base para el sistema jurídico y sus repercusiones en la realidad, actualmente se tiene un origen hegemónico iniciado en Grecia y uno contra-hegemónico iniciado con el método de Friedrich Schleiermacher y ha pasado por varios giros, todos ellos de autores alemanes, el primero que se puede considerar es la hermenéutica del lenguaje Wilhelm Dilthey, el segundo, es el existencialismo de Martin Heidegger, para pasar así al actual giro hermenéutico que influye actualmente la ciencia jurídica de Europa y América, el giro de comunidad-dialógica argumentativa, con autores como Jurgen Habermas, George Gadamer y Karl-Otto Apel. Pero existe la posibilidad de un giro hacia la trascendentalidad de lo real, a esta se acercó el tercer y último Karl-Otto Apel con su libro Paradigmas de la filosofía primera, pero nadie como Xavier Zubiri en los años 60´s y de 1980-1983, con su metafísica madura, donde planteó al inteligir humano como realidad respectiva entre otras realidades que son suyas de sí, la teoría del autor español, es capaz de dar otro sentido, por ello, hermenéutica jurídica alternativa, que propicie un derecho más cercano a lo real (o la trascendentalidad).

Legal hermeneutics, understood as the meaning of law, is the basis for the legal system and its repercussions in reality. Currently, there is a hegemonic origin initiated in Greece and a counter-hegemonic one initiated with the method of Friedrich Schleiermacher and has gone through several twists, all of German authors, the first that can be considered is the hermeneutics of language Wilhelm Dilthey, the second is the existentialism of Martin Heidegger, to move to the current hermeneutical turn that currently influences the legal science of Europe and America, the argumentative dialogical-community turn, with authors such as Jurgen Habermas, George Gadamer and Karl-Otto Apel. But there is the possibility of a shift towards the transcendentality of the real, this was the third and last Karl-Otto Apel with his book Paradigms of the first philosophy, but nobody like Xavier Zubiri in the 60's and 1980-1983 , with its mature metaphysics, where it raised the human intellect as a respective reality among other realities that are his own, the theory of the Spanish author, is able to give another meaning, therefore, alternative legal hermeneutics, which promotes a right closer to the real (or transcendentality).
