Do recato à rebeldia: o estigma de ser mulher diante de uma condenação por tráfico de drogas da cidade do Recife

    The goal of this paper is to verify if the gender prejudice has any kind of influence in the judicial sentences of women condemned by drug trafficking, in the city of Recife in year of 2015. The hypothesis is that such sexism, derived from a patriarchal and macho society, is reproduced in the judgment of these women and it might represent double punishment: by being a woman and for the crime itself. Through the theoretical framework of critical and feminist criminology, a content analysis of forty sentences of the narcotics court of said municipality was conducted by using the qualitative method. It was noted that there is a great deal of the abuse by the police, as well as different ways of treating the condemned woman, varying according to the magistrate’s consideration of liars, “poor women” and head of traffic. Thus, there is a real game of manipulation between the submission and the rebellion.

    O trabalho tem como objetivo identificar a existência ou não de práticas de preconceito de gênero nas sentenças de mulheres condenadas por tráfico de drogas na Comarca de Recife no ano de 2015. Isso porque se parte da hipótese de que tais sexismos, advindos de uma sociedade patriarcal e machista são reproduzidos nos julgamentos e pode representar uma dupla punição: pelo simples fato de ser mulher e pelo crime propriamente dito. Através do marco teórico da criminologia crítica e feminista, fez‑se análise de conteúdo por meio do método qualitativo de quarenta sentenças das varas de entorpecentes do referido município. Notou‑se grande abusividade da atuação da polícia, além de diferentes formas no tratamento da mulher quando no banco dos réus, variando conforme a consideração do magistrado entre mentirosa, “coitadinha” e chefe do tráfico. Assim, o que se tem é um verdadeiro jogo de manipulação entre o recato e a rebeldia.
