Le Sezioni Unite confermano che la parte civile può ricorrere per cassazione ex art. 325 c.p.p. avverso l’ordinanza del Tribunale del riesame soltanto nel caso in cui non sia stata messa in condizione di partecipare al relativo procedimento. La decisione offre lo spunto per una riflessione sulla tutela riconosciuta al danneggiato dal reato che decida di esercitare l’azione civile in sede penale.
