Attraverso l’analisi del recente d.lgs. 1° marzo 2018, n. 21, vengono esaminate le diverse criticità derivanti dall’introduzione dell’art. 3-bis c.p. In particolare, l’Autore si sofferma sull’effettività del principio di riserva di codice, in relazione anche alle ulteriori modifiche normative apportate dalla cd. Riforma Orlando.

Through the analysis of the recent legislative decree 1 March 2018, n. 21, are examined the various critical issues connected to the introduction of the new art. 3-bis c.p. In particular, the Author analyzes the effectiveness of the new concept of “Code Reservation”, related to the latest changes in the subject implemented by the Orlando reform.
