De iure condendo, is it a reason to exclude the presence of civil party, person with civil liability for damage and person with civil liability for financial penalties or one more reason to review the structure of the “giudizio abbreviato”?
Le differenze fra le posizioni delle parti eventuali persistono nella disciplina del giudizio abbreviato anche dopo la riforma Orlando, che contribuisce a rimarcare i già ridotti spazi probatori e la minorata tutela dei diritti. De iure condendo, è un motivo per escludere la presenza delle parti eventuali o una ragione in più per rivedere l’assetto del giudizio abbreviato?
