El Decreto que resuelve la cuenta jurada de Procurador (Artículo 34 LEC) y Abogado (Artículo 35 LEC) es irrecurrible, pero no prejuzga lo que pueda decidirse en un proceso declarativo posterior. Siendo así, las preguntas que pueden plantearse en torno al mismo son varias: ¿afecta esa irrecurribilidad al principio de exclusividad de la potestad jurisdiccional? ¿a la tutela judicial efectiva? ¿cómo se desplegará como título ejecutivo llegado el caso? ¿y cómo podría evitarse una eventual confrontación procesal de resoluciones?
The Decree that resolves the sworn account of the Procurador (assistant solicitor) (Section 34 of the Civil Procedural Act (LEC)) and the Lawyer (Section 35 of the Civil Procedural Act (LEC)) cannot be subject of an appeal, but it does not prejudge what can be decided later in a declarative process. Being so, the questions that may arise around this issue are varied: Does this non-appeal affect the principle of exclusivity of jurisdictional power? And the right to an effective judicial protection? How will it be deployed as enforcement whenever appropriate? And how could a possible confrontation of procedural resolutions be avoided?
