Resumen de La legge sull’immigrazione brasiliana come meccanismo per stimolare la costruzione d’una società più fraterna

Questa ricerca ha come scopo analizzare la Legge nº 13.445, del 24 maggio 2017 regolamentata dal Decreto n. 9.199, del 20 novembre 2017 che ha revocato espressamente la Legge n. 6.815, del 19 agosto 1980 (Statuto dello Straniero) che presenta un approccio d’effettività dei diritti umani riguardo ai migranti e rifugiati in un contesto di flussi migratori crescenti, così come mira alla loro integrazione alla società brasiliana come soggetti aventi diritti e doveri. La ricerca è di natura teorico-bibliografica secondo il metodo descrittivo - deduttivo, che ha istruito l’analisi della legislazione, così come la dottrina che informa i concetti d’ordine dogmatico.

This research aims to analyze the 13.445 Act, 24 May 2017 regulated by 9.199 Decree, 20 November 2017 which has explicitly revoked 6.815 Act, 19 August 1980 (Statute of the Foreigner) which has a bias of human rights effectiveness in relation to migrants and refugees in context of a growing migratory flux as well as for integration into Brazilian society as the rights and obligations persons. It’s a theoretical-bibliographical-natured research guided by a descriptivedeductive method which had instructed the analysis of legislation, as well as the doctrine that informs the concepts of dogmatic order.
