Resumen de Aspectos esenciales de la garantía legal en el estatuto del consumidor colombiano

  El presente artículo implica un análisis de los aspectos elementales y más importantes de la garantía legal contemplada en la Ley 1480 de 2011. Se estudian las características esenciales de dicha garantía y se evidencia el tratamiento disímil que respecto a la misma contempla la ley teniendo en cuenta la naturaleza del producto (bien o servicio). En el texto se detalla el concepto de servicio y se precisa a qué tipología deservicio le es aplicable la garantía, resaltando que solo es aplicable a los servicios regidos por una relación de consumo y no reglados por normas especiales. También se destaca que este punto merece mayor regulación por el legislador. Finalmente se explican los mecanismos para hacer efectiva la garantía legal.

  The present work is a brief legal investigation, in which a description and analysis of the elementary and most important aspects of the legal guarantee contemplated in Law 1480 of 2011 is carried out. The essential characteristics of this guarantee are studied and It is evident the dissimilar treatment that regarding the same contemplates the law taking into account the nature of the product (good or service). The text details the concept of service and specifies to which type of service the warranty is applicable highlighting that it is only applicable to services governed by a relationship of consumption and not regulated by special rules.

  It is also stressed that this point deserves further regulation by the legislature. Finally, the mechanisms for enforcing the legal guarantee are explained.
