    El criterio de la nueva regulación es el de ampliar, tanto cualitativa como cuantitativamente, la responsabilidad del explotador de una central nuclear. Ampliación que, en ambos aspectos, va por delante de lo que el mercado asegurador tradicional técnicamente viene estando en condiciones de atender. Ello ha provocado la necesidad de que fondos públicos sirvan para cubrir aquello donde las compañías aseguradoras no llegan. La aplicación de lo requerido por la nueva regulación está aún en suspenso, en espera de que la mayor parte de los países firmantes ratifiquen el Protocolo de 2004 al Convenio de París.     The criteria followed by the new regulation is to both qualitatively and quantitatively broaden the liability of a nuclear power plant operator.

    This increase, in both senses, goes above and beyond what the traditional insurance market is technically in a position to handle. This has resulted in the need for public funds to cover what the insurance companies cannot.

    Enforcement of the requirements of the new regulation has been postponed because most of the signatory countries have not ratified the 2004 Protocol to the Paris Convention. At this time it is difficult to say when this will take place.
