A partir de una concepción de la violencia de género como un fenómeno estructural en Ecuador, exploro la tensión que existe entre el reconocimiento del pluralismo jurídico y el respeto del derecho humano de las mujeres indígenas a una vida libre de violencia. En esta línea tomo como objeto de estudio los instrumentos internacionales que protegen derechos humanos de las mujeres y derechos colectivos de los pueblos indígenas para entender el modo en que han reproducido el discurso dicotómico entre derechos colectivos e individuales –con incidencia en los planos global, nacional y local–, lo cual termina afectando a las mujeres indígenas frente al fenómeno de la violencia de género y su acceso a la Justicia ecuatoriana

From a conception of gender violence as a structural phenomenon in Ecuador, I explore the tension that exists between the recognition of legal pluralism and the respect of the human right of indigenous women to a life free of violence. In this line, I study the international instruments that protect the human rights of women and the collective rights of indigenous peoples to understand the way in which they have reproduced the dichotomous discourse between collective and individual rights. I address their impact on the global, national and local levels, which ends up affecting indigenous women in the face of the phenomenon of gender violence and their access to Ecuadorian Justice.
