Resumen de Las relaciones entre el Tribunal Constitucional y el Tribunal Supremo: ¿un conflicto permanente?

El presente trabajo tiene por objeto dar cuenta de los problemas que genera la dualidad de jurisdicciones. Concretamente y por lo que respecta al caso español, se repasan los episodios conflictivos que han tenido lugar entre el Tribunal Constitucional y el Tribunal Supremo. Asimismo, se analizan las causas generadoras de esta situación y se ve en la reforma del amparo llevada a cabo por la Ley Orgánica 6/2007, de 24 de mayo, una posible salida a esta situación de conflicto, normalizando las relaciones entre TS y TC.

The present work aims to account for the problems generated by the existence of two jurisdictions. Specifically and as regards the Spanish case, the conflicting episodes that have taken place between the Supreme Court and Constitutional Court are reviewed. Likewise, the causes generating this situation are analyzed and it is seen in the reform of the amparo carried out by the Organic Law 6/2007, of May 24, a possible solution to this situation of conflict, normalizing the relations between TS and TC .
