    Le Sezioni unite sono chiamate a risolvere un contrasto interpretativo in merito alla legittimazione dell'indagato a impugnare con ricorso per cassazione l'ordine d’imputazione coatta emesso dal giudice per le indagini preliminari per un reato diverso da quello per il quale l’organo inquirente aveva richiesto l'archiviazione. Dopo avere illustrato i diversi orientamenti, l'Autrice spiega le ragioni per le quali non può non riconoscersi all'indagato la legittimazione a impugnare tale provvedimento, trattandosi di atto abnorme che lede sia le prerogative del pubblico ministero in merito all’esercizio dell’azione penale sia il diritto al contraddittorio
