Resumen de La autonomía de la voluntad del paciente y los testamentos vitales

El presente artículo pretende demostrar la utilidad de los denominados «testamentos vitales», documentos que promueven el respeto de la autonomía de la voluntad de los pacientes con respecto a las decisiones que puedan afectar a los cuidados y atenciones médicas que deseen recibir en el momento final de sus vidas. Para ello, tras fijar el marco normativo estatal y autonómico que existe en nuestro país en esta materia, abordaremos los requisitos de capacidad de sus otorgantes, su contenido y elementos formales, así como la figura del representante del paciente, que es la persona facultada por éste para adoptar o comunicar sus decisiones en el momento oportuno. Terminaremos nuestro estudio con la inscripción del testamento vital en los registros administrativos competentes y con las conclusiones adoptadas.

This dissertation aims to demonstrate the convenience of granting living will documents, since they promote respect for patients» autonomy regarding their end-of-life medical care decisions. For this purpose, after setting the Spanish legal regulatory framework of this type of records, both state and regional, we will address the capacity requirements of their grantors, their content and formal conditions involved, but also the figure of the Patient’s Representative, who is the person empowered to make or communicate health care decisions on behalf of the patient at the due time. Subsequently, we will resume our study with the registration of the living will in the competent administrative Registries and with the conclusions adopted
