Efectos acumulativos de la acción reguladora: Ejercicio de análisis del “CER, Consideration of the commulative Effects of regulation in the rulemaking process” en una central española

    La NRC, a través de la interacción con la industria americana es consciente, desde hace varios años, de la preocupación del impacto del efecto acumulativo de algunas acciones reguladoras. Como respuesta a esta preocupación, puesta de manifiesto por la industria, el staff de la NRC ha llevado a cabo varias iniciativas de revisión de algunos requisitos reguladores, para asegurar que la regulación y las prácticas de la NRC no resultan en una carga reguladora innecesaria. Lo anterior responde a lo que se viene denominando comúnmente el “CER: Consideration of the Cumulative Effects of Regulation in the Rulemaking Process”.

    A la luz de la actuación reguladora por parte del Consejo de Seguridad Nuclear, y en especial tras los sucesos acontecidos en Japón, se ha realizado un ejercicio piloto para la consideración del “CER” en una planta española, con el objeto de analizar los efectos acumulativos de la regulación y proponer mejoras de cara a la gestión de su emisión en la línea marcada previamente por la NRC en diversos documentos (SECY-02-081, SECY-11-0032, SECY-12-0137).

    Through its interaction with the American industry, the NRC has been aware for a number of years of the concern about the impact of the accumulative effect of some regulatory actions. In response to this concern, which was highlighted by the industry, the NRC has carried out initiatives to review a number of regulatory requirements in order to ensure that NRC regulation and practices do not lead to an unnecessary regulatory load. The foregoing was in response to what has become commonly known as the “CER”, Cumulative Effects of Regulation in the Rulemaking Process.

    In view of the regulatory actuation by the Spanish Nuclear Safety Council (CSN) and, in particular, after the events which occurred in Japan, a pilot study has been carried out to examine the “CER” on a Spanish plant in order to analyse the cumulative effects of regulation and to propose improvements to the management of regulation in line with that set out by the NRC in various documents (SECY-02-081, SECY-11-0032 among others).
