    This article objectives to analyze the legal treatment and the procedure adopted by Brazil on clinical research with basis on the Resolution nº 466/2012 from National Health Council. One of the major assumptions of the present article is the discussion about the preservation of the volunteer’s rights should during the experiments. Therefore, the article intends to distinguish the autonomy from the capacity of the participants, elucidating their importance to the protection of these individuals. Research ethics presuppose also the analysis of the vulnerability and the search for techniques that truly guarantee volunteer’s clarification and the practice of a free and informed consent. This depends on the realization of a suitable and effective procedure during the research involving human beings, protecting on a wider perspective their human dignity and human rights.

    Trabalho destinado à análise jurídica da proteção conferida pelo ordenamento brasileiro às pesquisas envolvendo seres humanos, com fundamento na Resolução nº 466/2012 do Conselho Nacional de Saúde. Busca-se identificar os direitos fundamentais dos participantes da pesquisa que devem ser resguardados no curso dos experimentos. Pretende-se, ainda, tratar da autonomia e da vulnerabilidade, como pressupostos ínsitos à situação de pesquisa, esclarecendo a sua relevância para a maximização da tutela. A questão também será analisada a partir da ética, que pugna pela captação da exteriorização de uma vontade verdadeiramente esclarecida, considerando, inclusive condições de vulnerabilidade. Tal garantia depende da coleta de um consentimento adequado e eficaz por parte do pesquisador responsável, resguardando de forma mais ampla a dignidade e os direitos daqueles sujeitos que participam da pesquisa.
