    The conviction in question gives rise once again to a debate, considered to have been dormant for sev-eral months, regarding the replacement of the legal defence lawyer during the trial. The Supreme Court, therefore, going back on its steps jointly re-examined article 14 of the Legislative Decree 247/2012 and article 9 of the Law Decree 1578/1933, positively resolving the issue in favour of the rediscovered orality of the delegation of powers rendered out of courtby the substitute deriving from the principal lawyer and orally put forward to the presiding judge.

    La decisione in esame desta nuovamente un dibattito, considerato sopito da diversi mesi, riguardo la sostituzione processuale del difensore in corso di giudizio. La Suprema Corte, dunque, tornando indie-tro sui suoi passi, ha esaminato nuovamente e congiuntamente gli artt. 14 d.lgs. 247/2012 e 9 d.l. 1578/1933, risolvendo positivamente la questione presentata, in favore della riscoperta oralità della delega al sostituto resa extra iudiciumdal dominus causaee dal primo oralmente riproposta al giudice procedente.
