Resumen de La problemática de los clubes de cannabis: ¿error de tipo o error de prohibición?

La proliferación de asociaciones dedicados al autoconsumo de cannabis es una constante en España y nuestro entorno cultural. Se cuestiona si la actividad desarrollada por los directivos de los mencionados clubes se puede encuadrar en la doctrina de la atipicidad del autoconsumo compartido. No siendo así, se cuestiona la posibilidad de aplicar error de tipo o error de prohibición a las tales actuaciones. El TS ha aplicado en distintas sentencias el error de prohibición, mientras la Fiscalía reclama que se aplique el error de tipo. En este trabajo se concluye que se puede apreciar la concurrencia de ambas modalidades de error: error de prohibición (aunque no como lo plantea el TS, sino como un error sobre los límites en la causa de atipicidad) y un error de tipo, al concurrir desconocimiento sobre un elemento normativo del tipo.

The proliferation of cannabis self-supplying associations is a constant in Spain and our cultural environment. It is questioned if the activity developed by the clubs’ directives can be framed into the Spanish doctrine of the “lack of criminal responsibility (atipicidad) of the shared self-supply of drugs”. If not, it can be questioned what kind of legal error can be applied to these acts. The Spanish High Court has applied in different decisions the “error on the legal mandates“ type (error de prohibición), whilst the prosecutors claim the application of the “error on the facts that imply criminal offences” (error de tipo) doctrine. This essay concludes that it can be appreciate the concurrence of both types of error: error de prohibición, as a mistake on the boundaries of the cause of the lack of criminal responsibility, and error de tipo, due to the lack of knowledge of a normative element of the tipo (the legal description and the subjective requirements of the crime).
