La evolución de las nuevas tecnologías, y los nuevos servicios que allí se dan tiene como consecuencia que se trasladen a dicho ámbito disputas, del mundo analógico, en torno a las marcas. En este documento analizaremos una sentencia del Tribunal General de la Unión Europea, que intenta dirimir un recurso contra una resolución de la European Union Intellectual Property Offices (EUIPO). Resolución que, en esencia, deniega al recurrente la “oposición de registro de marca” en base a la similitud con una marca registrada anteriormente y por tanto el potencial riesgo de confusión para el público. Se analizará, entre otras cuestiones, el carácter distintivo de las marcas implicadas, los elementos de similitud y de distintividad entre ambas marcas, y el posible riesgo de confusión.
The evolution of new technologies, and the new services that are given, have consequences. Problems of the analogue world are traced to the field of brands. The disputes of the analogical world are transferred to brands area. In this document we analyze a judgment of the General Court of the European Union, which attempts to settle an appeal against a resolution of the European Union Intellectual Property Offices (EUIPO). Resolution that, in essence, denies the appellant the "opposition of trademark registration" based on the similarity with a previously registered trademark and therefore the potential risk of confusion for the public. It will analyze, among other issues, the distinctive character of the brands involved, the elements of similarity and distinctiveness between both brands, and the possible risk of confusion.
