La monoparentalidad derivada de la violencia de género: análisis de la cuestión

    En el presente estudio abordaremos la situación de monoparentalidad, pero no en un sentido general, sino que atenderemos a la que se produce como consecuencia y derivada de la violencia de género. Cierto es que se carece de una legislación estatal que atienda a esta situación, pero ello no es óbice para que sean cada vez más el número de familias monoparentales o monomarentales. Tomando como pretexto el Decreto 19/2018, de 9 de marzo, del Consell, por el que se regula el reconocimiento de la condición de familia monoparental en la Comunitat Valenciana, vamos a ocuparnos de cómo se contempla en los casos de violencia de género. Hay que tener en cuenta la afectación al menor, así como la necesidad de articular mecanismos de protección suficientes teniendo en cuenta necesidades de inclusión en nuestra sociedad, y se plantean algunas cuestiones que es necesario darles una respuesta (por ejemplo, la situación de la vivienda habitual; la custodia compartida en la situación de violencia de género, entre otras). La metodología que se va a utilizar será un análisis de la normativa, se atenderá a la postura de la doctrina especializada en orden a determinar cómo mejorar la situación de la unidad familiar afectada. De dicho estudio extraeremos unas conclusiones para observar el grado de protección que concede la normativa, así como cómo se podría mejorar la situación de una monoparentalidad no elegida, sino derivada de una situación de violencia.

    In the present study we will address the situation of single parenthood, but not in a general sense, but we will attend to the one that occurs as a consequence and derived from gender violence. It is true that there is no state legislation to address this situation, but this is not an obstacle for more and more families to be single-parent or single-parent families. Taking as pretext the Decree 19/2018, of 9 March, of the Consell, by which regulates the recognition of the condition of single-parent family in the Valencian Community, we are going to deal with how it is contemplated in the cases of gender violence. It is necessary to take into account the effects on the minor, as well as the need to articulate sufficient protection mechanisms taking into account the needs of inclusion in our society, and there are some questions that need to be answered (for example, the housing situation habitual, shared custody in the situation of gender violence, among others). The methodology that will be used will be an analysis of the regulations, the position of the specialized doctrine will be taken into account in order to determine how to improve the situation of the affected family unit. From this study we will draw conclusions to observe the degree of protection granted by the regulations, as well as how the situation of an unchosen single parent could be improved, but derived from a situation of violence.
