    El marco de protección de las inversiones extranjeras se encuentran regulados en mayor medida por los Acuerdos de Promoción y Protección Recíproca de Inversiones, entre los tratamientos que otorgan a los inversionistas extranjeros y a su capital encontramos el Trato Justo y Equitativo, algunos autores señalan que este estándar deja mucho que decir a los tribunales arbitrales de inversión, así pues se considera que se violenta el principio de seguridad jurídica, así pues, es importante tratar de clarificar si realmente lo hace o este tipo de estándares son creados intencionalmente para este tipo de situaciones y resueltos ex post facto-después de los hechos
