  La investigación parte de la problemática de Identificar las principales carencias e El trabajo tiene como punto de partida la concienciación social sobre la necesidad de proteger a los animales, la que está incrementándose en el mundo como una necesidad emergente a partir de la Filosofía como ciencia social hacia el Derecho, del que Cuba como nación no está ajena a esta situación, para ello desde las Ciencias Veterinarias hay vastos estudios señalando la necesidad de su regulación para que propicie el bienestar a los animales ante las conductas inadecuadas de la ciudadanía. El Derecho Animal constituye una rama individual derivada del Derecho Ambiental por la correlación que existe entre ambas materias desde la ciencia del Derecho, y su necesidad de regulación en el ordenamiento jurídico cubano para lograr el bienestar animal en el siglo XXI. Hay reflexiones desde la mirada antropocéntrica desde el ámbito jurídico que trasciende a otros saberes ante la ausencia de un instrumento jurídico marco sobre la protección del bienestar animal parece ser una laguna en el derecho internacional latente en el Derecho Internacional, que propicie su desarrollo dentro de los ordenamientos jurídicos internos
